Terms of Service

These Terms of Service (“Terms”) govern your use of larkspin.com and the Larkspin beta service (the “Service”). By visiting, creating an account, making a purchase, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Larkspin.

Who may use Larkspin

You must be at least 18 years old to visit or use Larkspin. By using the Service, creating an account, or making a purchase, you confirm that you are 18 or older and able to form a binding contract. People under 18 may not use the Service. If you use Larkspin on behalf of an organization, you also confirm that you are authorized to accept these Terms for it.

Your account

You are responsible for your account credentials and for activity under your account. Keep your password confidential and notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms or create risk to the Service or others.

The Service and AI-generated content

Larkspin creates interactive fiction using artificial intelligence. Generated material is produced automatically and may be inaccurate, unexpected, repetitive, upsetting, or unsuitable for some readers. It is fiction and should not be relied on as factual, professional, medical, legal, or other advice. You direct the story through your prompts and choices, but we do not guarantee any particular output, tone, or outcome.

Content ownership and license

As between you and Larkspin, you retain any rights you have in the prompts, characters, and choices you provide and in resulting stories, to the extent the law and our AI provider’s terms allow. AI-generated material may not qualify for copyright protection in every jurisdiction. You grant Larkspin a limited, worldwide, non-exclusive license to host, process, transmit, store, and display your content only as needed to operate, secure, and support the Service—for example, to generate chapters, save your library, and display stories you choose to publish. Larkspin does not sell your private story content or use it to train its own models.

Acceptable use

You agree not to use the Service to:

• break the law or infringe others’ rights;
• generate or publish content that sexualizes minors, incites violence, harasses, or facilitates serious harm;
• publish another person’s private or identifying information without permission;
• attempt to evade usage limits, credits, or security; probe, scrape, or disrupt the Service; or reverse-engineer it except where that restriction is legally unenforceable;
• misuse the AI provider in violation of its usage policies.

Stories and sharing

Your stories are private unless you publish them. If you publish a story to a public link, you are responsible for what it contains and for your right to share it. Public links may be reported by readers and may be removed, and accounts may be limited, when content violates these Terms or creates safety, legal, or operational risk.

Stories and payments

• A story runs from its opening line to a real ending, written for you as you read it. Each new account receives one included story. After that, each purchase adds stories to your balance; beginning a story draws one from that balance and covers all of that story’s chapters, under the product rules shown at the time of purchase.
• Prices, what a purchase includes, and any refund eligibility are shown before checkout. Payments are processed by Stripe; by purchasing you also agree to Stripe’s terms.
• Stories in your balance do not expire, are not currency or stored value, and cannot be transferred, resold, or redeemed for cash.
• We may change prices and packs prospectively; changes do not affect stories you have already purchased.

If a new story fails before its first chapter is completed, Larkspin is designed to return the story to your balance automatically. Other refund requests are considered where required by law or when the purchased Service was not delivered as described. Email readlarkspin@gmail.com for help. Nothing in these Terms limits any mandatory consumer rights that apply to you.

Intellectual property

The Service itself — including the Larkspin name, look and feel, software, and content we provide (excluding your content) — is owned by us or our licensors and protected by law. These Terms do not grant you any right to our trademarks or branding.

Availability and changes

The Service may change, be interrupted, or be discontinued at any time. We do not promise uninterrupted generation or permanent storage. Keep your own export of any story you cannot afford to lose.

Disclaimers

To the fullest extent permitted by law, the beta Service is provided “as is” and “as available.” We do not promise that Larkspin will always be available, error-free, or suitable for a particular purpose, or that AI-generated content will be accurate, reliable, or appropriate for every reader. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Larkspin and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill. For a claim connected to a paid story or story pack, our total liability will not exceed the amount you paid for that purchase. Nothing in these Terms excludes liability or consumer remedies that cannot legally be excluded or limited.

Indemnification

To the extent permitted by law, you are responsible for claims arising from content you publish, unlawful use of the Service, or your violation of these Terms or another person’s rights.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.

Governing law and disputes

These Terms are governed by the laws that apply to the Larkspin operator and your use of the Service, without taking away any mandatory protections provided by the law where you live. Any dispute must be brought in a court with legal authority over the parties and the dispute.

Changes to these Terms

We may update these Terms as the Service evolves. We will update the “Last updated” date and, for material changes, provide a more prominent notice. Continued use after an update means you accept the revised Terms.
